New rules In 2018, who has the right to park in a disabled parking lot? Today, the driver of a vehicle with the identification sign “Disabled” is required to carry and present to the traffic police officer a certificate of disability. If a vehicle is driven by several drivers, and not all of them are disabled, a quick-removable identification plate must be installed on the vehicle. In accordance with the traffic rules, benefits for paid parking for disabled people apply only to disabled people of groups 1 and 2, as well as to any group when transporting disabled children. Thus, a driver without health limitations also has the right to purchase and install a “Disabled Person” sign, but he no longer has the right to stop in parking lots for the disabled. Area of validity of the sign If we are talking about the “Parking for the Disabled” sign, then its effect extends to all places that are located near it, but in most cases a group of similar signs is duplicated by markings on each of the places, which are carried out in the prescribed manner and in accordance with the sample . Paid parking rules and benefits for people with disabilities in 2018

As it was before Until recently, the use of parking for disabled people was not clearly enshrined in legislation; the text of the resolution did not mention the need to have a certificate of disability; there was no information that the right to install a “Disabled Person” sign does not apply to cars transporting healthy citizens. The sign could be installed on any vehicle in which disabled people are systematically or periodically transported. At the same time, the traffic police inspector had the right to punish anyone who stopped in a parking space designated for disabled people, regardless of the presence or absence of a disability certificate. Although, according to the law, such a certificate was not included in the list of documents that the driver must present to the inspector.
The fine for illegal parking was only 200 rubles.

Features of parking for disabled people

Fine for illegal use of parking spaces In any region of the country, drivers are subject to a fine if they take a parking space for a disabled person without grounds or documentary evidence. Its amount is 5,000 rubles, and it is assigned only after the inspector checks the documents or discovers clear signs of a violation. If the driver is not nearby, then a law enforcement officer can call a tow truck and record the loading process with the help of witness statements or record it on video, so that if damage is detected, the driver can verify that there were no violations of the towing procedure.
Latest innovations after the reform The need for documents confirming disability arose only after the reform of the document verification procedure.

Info

According to the Rules of the Road, the effect of sign 6.4 (“Parking”) together with plate 8.17 (“Disabled Persons”) applies to motorized strollers and cars driven by disabled people of group I or II, or transporting disabled people and disabled children. It does not matter whether this is done by a specialized vehicle, equipped for transporting persons with disabilities, or a simple vehicle.

Is it possible for a disabled person to park in all paid parking areas?

Responsibility for violating the rules How much is the fine for parking in a disabled space in 2018? Just a few years ago, the fine was only 200 rubles, and as a result, drivers abandoned their cars anywhere. Despite the increase in the amount of penalties, car owners continue to violate the rules; in this regard, the issue of toughening penalties is being considered, including deprivation of a driver’s license and initiation of legal proceedings. Today, the following penalties are legislated:

  • 5 thousand rubles - for an individual;
  • 10 - 30 thousand rubles. - for an individual;
  • 30-50 thousand rubles. - for an official.

In addition to the fine, transportation of the vehicle to the impound area is also provided; the vehicle can be returned only after the fine has been paid in full.

Legislative basis The Federal Law “On Social Protection of Disabled Persons in the Russian Federation” dated November 24, 1995 No. 181-FZ obliges parking lot owners to allocate parking space specifically for people with benefits. According to its norms, at least 10% of the total number of seats is planned for preferential users. The Code of Administrative Offenses of the Russian Federation (CAO RF) provides for punitive measures against individuals and legal entities that do not comply with regulatory requirements regarding parking for disabled people. Download for viewing and printing the Federal Law of November 24, 1995.

No. 181-FZ - On the social protection of disabled people in the Russian Federation To whom does the benefit apply? Benefit categories include drivers directly driving vehicles of all disability groups, as well as vehicles transporting disabled people, including disabled children.

According to the traffic rules, there are two signs designed to notify road users that a person with special health conditions is driving or simply in a car:
  1. “Disabled” is a yellow square with a side of 15 cm and a figure of a wheelchair user inside.
  2. “Deaf Driver” is a yellow circle with a diameter of 16 cm, inside of which three black dots form a triangle.

The installation of these signs is voluntary. But strictly defined categories of citizens can use them.

Who can stick a “Disabled” sign on the car window?

The persons transporting them, as well as the parents of disabled children, also have the right to do this.

The driver of a car with a “Disabled Person” sign, in addition to his license, vehicle registration certificate and insurance, is required to carry with him “a document confirming the fact of disability” (Resolution of the Russian Government of January 21, 2016).

What specific document is not established by law. But it must indicate the group and cause of disability. Such documents are a pension certificate and a certificate of completion of a medical and social examination (the so-called pink form).

When stopped by a traffic police inspector, a disabled driver or a driver transporting a disabled person must present the original of one of these documents. Copies, even notarized ones, are not accepted.

What privileges does the “Disabled” sign on a car give?

Cars with “Disabled” signs installed on the windshield and rear windows are not subject to a number of prohibitory signs (Section 3 of Appendix 1 of the Traffic Regulations):
  • "Movement Prohibition";
  • “The movement of motor vehicles is prohibited”;
  • "No parking";
  • “Parking is prohibited on odd days of the month”;
  • “Parking is prohibited on even days of the month.”

But most importantly, the “Disabled” sign gives the right to use specialized parking spaces.

What is disabled parking?

In parking lots near socially significant facilities, at least 10% of the spaces must be reserved for parking for people with disabilities (Article 15 of the Federal Law “On Social Protection of Disabled Persons in the Russian Federation”). That is, near any clinic, cultural center or shopping center there must be at least one specialized parking space.

The parking space for people with disabilities is indicated by sign 6.4 and plate 8.17, as well as special markings

Only cars with a “Disabled” badge are allowed to occupy these seats.

Why are disabled parking lots always occupied by non-disabled people?

There are two reasons:
  1. The most convenient parking spaces are allocated for drivers and passengers with disabilities.
  2. Parking for disabled people is free.

Previously, parking spaces for the disabled were occupied by all and sundry. A fine of 200 rubles did not frighten anyone. In 2016, the legislation was tightened, and unscrupulous motorists began to carry a yellow sign with a wheelchair in the glove compartment, just in case. (It is sold absolutely freely and costs mere pennies.) It is unlikely that the inspector will wait for several hours for the driver to check the documents.

But the larger the city and the more acute the problem with parking, the more inventive motorists are. In Moscow, cars with the “Disabled” sign are entered into a separate register, and their owners are issued special parking permits. They give you the right to stand as long as you need, even in paid parking lots. For this reason, car owners buy fake disability certificates.

What threatens those who illegally use the “Disabled” sign and parking lots for people with disabilities?

Violators face fines. The Code of the Russian Federation on Administrative Offenses has three articles about this:
  1. Article 12.4 on the illegal installation of the “Disabled Person” sign. The fine is 5,000 rubles for individuals, 20,000 rubles for officials and 500,000 rubles for legal entities. Plus the removal of the sign itself.
  2. Article 12.5 on driving a vehicle on which the “Disabled” sign is illegally installed. The fine for the driver is 5,000 rubles. Plus confiscation of the sign.
  3. Part 2 of Article 12.19 on violation of the rules for stopping and parking vehicles in places for disabled people. Fine - 5,000 rubles.

Are disabled people really protected on the road?

Despite large fines, people with disabilities constantly face rudeness from able-bodied motorists, and due to imperfect legislation they find themselves in various unpleasant situations.

Since 2012, car parking in the center of Moscow has been a paid service. But there are some categories of citizens who have the right to do this for free. This includes people with disabilities. Find out in more detail what they are like for people with disabilities.

Parking spaces for disabled people

After the introduction in accordance with the Federal Law “On Social Protection of Disabled Persons in the Russian Federation,” their owners must allocate a certain number of free parking spaces. They are intended for vehicle owners who have In addition, they can be used by drivers transporting a person with disabilities. Parking rules in Moscow for disabled people state that owners of parking lots, including those located next to retail establishments, medical, sports and other institutions, must allocate at least 10% of parking spaces for vehicles of citizens with disabilities. Moreover, they can use these places for free.

How are these places designated?

As a rule, parking lots for the disabled have clearly visible markings 1.24.3, which differ from the markings 1.1 used to mark parking spaces. In addition, a sign (additional information sign) informs that this parking space is intended for disabled people.

What do you need to get a free parking space?

The rules state that citizens with disabilities have the right to use free parking in designated spaces. These include disabled people of groups I and II. The basis for this is an officially issued permit. At the same time, you can use the parking space around the clock. But the same parking rules in Moscow for people with disabilities indicate that when occupying a space that is not intended for citizens of this category, that is, one that does not have special markings, he must pay for it on a general basis.

When parking in a space intended for parking vehicles belonging to disabled people, the driver must have documents confirming this fact. This can be either a standard certificate or a certificate. A special sign pasted on glass is not evidence of disability. On the other hand, its presence or absence is left to the discretion of the car owner. By law, the presence of this sign on a vehicle is not required.

Who else can use free parking?

There is another category of citizens who can take advantage of such a benefit as parking for the disabled in Moscow. The rules permit the use of these places by those transporting persons belonging to this group. It does not matter whether this is done by a specialized vehicle, equipped for transporting persons with disabilities, or a simple vehicle. Drivers who are not disabled, but regularly transport them or accompany disabled children, may install a sign on their vehicle and occupy a space designated for parking vehicles belonging to disabled citizens. This is only possible during the transportation of a disabled person who has supporting documents with him. In all other cases, Moscow parking rules for disabled people consider the presence of a sign on a car to be illegal.

Who issues a parking permit?

According to Appendix No. 4 of the Moscow government decree, a special register has been maintained since 2013, which takes into account parking permits for citizens with disabilities. Its formation is carried out by the State Public Institution "AMPP". The register contains the following information:

  • Full name of the disabled person;
  • his contact details or the contact details of his representative;
  • information about place of residence;
  • car data (make, registration number);
  • term and date of disability;
  • indication of the preferential category;
  • validity period and registration number of the parking permit.

For which vehicle can a permit be issued?

The parking rules for disabled people in a paid parking lot also stipulate the requirements for a car for which a permit can be issued. To do this, he must meet several conditions.

  1. The vehicle is owned by a citizen with a disability.
  2. The car belongs to the person who is the legal representative of the disabled child.
  3. The car was provided to a disabled person for medical reasons by social services. protection.
  4. The car is the property of the person transporting the disabled person, unless a fee is charged for this.

Registration procedure

To apply for a permit, a citizen with a disability group or his representative must contact the multifunctional center, where a corresponding application is drawn up and submitted. Within ten days it and copies of the attached documents will be reviewed and a decision will be made.

In addition, it is possible to submit an application electronically. To do this, you need to go to the Moscow website of public services. If you are not registered on it, then register or log in. Then, in the “transport” tab, select “issue a parking permit.” After that, upload scanned copies of the required documents and submit your request. The result will also be known in ten days.

Required documents

The following documents must be attached to your parking permit application.

  1. Passport of a person on disability.
  2. Passport of his legal representative.
  3. If the appeal comes from a representative of a disabled child who is not his parent, a document confirming his authority.
  4. A certificate of disability or an extract from the examination report.

Pay attention! If information about a disabled person is not available in the Department of Social Services. defense of Moscow, then the consideration of the case will be suspended.

Penalties for parking lot owners

Despite the fact that they lose part of the profit, owners of paid parking lots are required to allocate the number of parking spaces that provide for parking rules for group 2 disabled people in Moscow. However, disabled people of group I have the same rights. Compliance with this is monitored by the Code of Administrative Offenses of the Russian Federation. In case of non-compliance with these rules, Article 5.43 comes into force, which provides for penalties for the lack of parking spaces intended for citizens with disabilities. For individuals, this can cost from 3 to 5 thousand rubles. Organizations will pay a fine of 30 to 50 thousand. Faced with such a choice, owners prefer to allocate and equip the necessary places rather than pay such amounts.

Fine for illegal use of parking

Despite the fact that the parking rules for Moscow quite clearly describe those categories of citizens who can take advantage of free spaces, it sometimes happens that they are occupied by cars of those who are not included in the outlined circle of people. Even if we do not consider the ethical side of this issue - you must agree, it is not very nice to take the place of those for whom overcoming extra meters often causes great difficulty - such an action can bring quite tangible troubles for the violator. The same provides for a fine of 5 thousand rubles in case of unlawful occupation of a parking space intended for a disabled person’s vehicle. By the way, this is the largest amount of money for illegal parking. Those who like to take other people's places are also at risk because traffic police officers usually monitor such parking lots very closely. After all, in order to issue a fine you need so little: wait for the inattentive or impatient driver to stop in a place with markings showing that this parking space is intended for a disabled person’s vehicle, take a photograph of the violation? gjckt xtuj you can issue a receipt.

And finally, I would like to note, gentlemen drivers, let's remain human! Yes, it often happens that the only free space left is parking for the disabled in Moscow, the rules of which can either be violated, or you will have to park at a considerable distance from the purpose of your trip. But for a healthy person, it is not very difficult to overcome the extra 100, 200, 300 meters. When occupying a parking space intended for a car of a person with disabilities, remember that it is much more difficult for him to overcome this distance.

Recently, in Russia, they have been highlighted everywhere in parking lots; this is common in special, including paid parking lots, and near shopping centers, and in courtyards near residential buildings.

Who does the sign apply to?

All designated parking spaces for people with disabilities must be marked with a special sign. "Disabled Parking" sign.

They can be used:

  • disabled persons of the first and second groups;
  • citizens who transport adults or minors with disabilities.

Persons with group 3 disabilities do not have the right to use such parking spaces, regardless of the fact that they receive a disability pension.

At the same time, a sticker on the glass of a vehicle, on the one hand, is not at all necessary to indicate status, and on the other hand, it cannot in any way officially confirm that a disabled person is in the car.

The driver, whether a citizen of the first or second group, or simply the driver transporting him, in order to use a special parking space must have documents that confirm this right, namely:

  1. Certificate of incapacity for work.
  2. Certificate from a medical institution confirming incapacity for work.

Typically, such cars are equipped with special stickers located on the windshield or rear window to alert other road users that a person with a disability is in the car.

But only a certificate of disability can confirm that the sign was placed legally.

Number of seats

According to the rules for arranging parking lots, including apartment buildings, it is mandatory to provide free parking spaces for disabled people, and there must be at least ten percent of the total number of such spaces ().

Most often, an area for cars with disabilities is set up closer to the exit and is marked with special markings and appropriate signs.

Near some institutions where the flow of people with musculoskeletal disorders is quite large (clinics, social services, etc.), at least 20% of the number of parking spaces for people with disabilities from the total parking area should be allocated.

The rules do not establish where exactly such zones should be located and what exact number of parking spaces there should be; each owner has the right to determine their number, the main condition is that their number should not be below the established minimum level.

According to Art. 15 of Law No. 181-FZ “On Social Protection...” of November 24, 1995, each organization, regardless of its organizational and legal form, is obliged to provide persons with disabilities with unhindered access to the facility. The same rule applies in public transport.

Violation of these requirements, according to, entails administrative liability in the form of a fine:

  • for officials the fine is from 3,000 to 5,000 rubles;
  • For organizations, the fine has been increased to 30 thousand – 50 thousand rubles.

Registration

Compared to public parking spaces, parking spaces for disabled citizens are arranged somewhat differently.

According to the rules in Moscow in 2019, the width of the parking lot increases by one meter and is at least 3.5 meters.

This is understandable: many people use wheelchairs and they must have a place both for unloading it from the car and for further travel between vehicles.

Typically, all parking spaces are located one after the other, this is both more convenient and allows you to increase the distance between two cars, which increases the possibility of maneuver.

All designated places are located no more than 50 meters from the establishment.

The special marking is a copy of a road sign painted on the asphalt with yellow paint. Parking for disabled people is designated according to traffic regulations using special markings and a “Parking for disabled people” sign.

At the same time, a sign is installed next to such a sign, notifying that this zone is intended only for parking cars of persons with disabilities, or for parking vehicles transporting such citizens, including special vehicles.

Documents

Since 2019, the rules for installing a “Disabled Person” sign on a vehicle have changed; this has become possible only after receiving a disability certificate.

Also, you can take advantage of free parking or other benefits provided to citizens with limited mobility only if you have such a certificate.

If the certificate is missing, traffic police officers can not only remove the sign from the car, but also fine its owner.

This tightening of requirements is due to the fact that some motorists illegally use the sign when trying to leave their car in parking areas for disabled citizens.

In addition to specially equipped parking spaces, persons with disabilities or their representatives have the right to ignore certain road signs.

Namely:

  1. Vehicle movement is prohibited;

    Figure 1. Sign 3.3 “Vehicle movement is prohibited”
  2. Parking is prohibited (Fig. 2);
    Figure 2. Sign 3.28 “Parking prohibited”

  3. Signs 3.29 and 3.30, parking on odd (even) days is prohibited (Fig. 3).
    Figure 3. Sign “Parking on odd (even) days is prohibited.

    All these rules apply to citizens who transport disabled people in their cars, but the requirement to have the necessary documents on hand also applies to these cars.

    Penalty for parking in a disabled space

    Not every person with disabilities is able to get behind the wheel of a car independently. Most often, they are transported by special vehicles, or they use the services of a taxi or relatives or friends.

    When transporting such people, vehicle owners have the right to install a special sign on their car and use parking spaces for disabled people for parking, but only if the passenger has a document that confirms his status.

    If these requirements are not met, the violator will be fined or other types of punishment will be applied to him.

    Table 1. Types of punishment for people with disabilities.

    How to check resolution

    In 2013, Moscow began recording the issuance of parking permits for persons with disabilities in a special register maintained by the State Public Institution “Administrator of the Moscow Parking Space”.

    The following data is required to be included in this document:

    • number and validity period of the permit;
    • personal data of the applicant, for a disabled child, data of his legal representative;
    • contact details and residential address;
    • information about the car in which a citizen with disabilities travels;
    • vehicle make;
    • vehicle registration number;
    • SNILS;
    • benefit category.

    All information contained in the document is carefully checked to prevent abuse.

    To park freely in paid parking lots, or to park cars in spaces for disabled people, everyone who qualifies for the benefit must obtain a parking permit.

    To do this, you need to visit the MFC or go to the website of the public services portal in Moscow (page address of the official website: pgu.mos.ru). The site is intended only for working with residents of the capital.

    When visiting the MFC you must have the following documents with you:

    • statement;
    • passport or birth certificate (for a child under 14 years of age);

    The permit is valid until the first day of the month following the date until which the disability was determined. For example, if the certificate is valid until March 21, 2019, then the permit will be valid until April 1 of the same year.

    The check is duplicated by mobile systems that check payment for parking in Moscow.

    When a permit is issued, all data on a disabled person’s vehicle is entered into the parking register; if necessary, traffic police officers or other authorized persons can quickly check whether such a permit was issued to a specific person.

    If the parking is not paid for, or the car is parked in an area intended for persons with disabilities, while the “Disabled Person” sign is installed on the vehicle, an online check is made to see whether the data for this car is actually included in the Parking Register.

    A parking permit for a person with disabilities entitles him to free parking in all parking areas in areas marked with sign 8.17 “Disabled persons”:

    or markup 1.24.3:

    In any other parking zones, car parking is permitted on a general basis. If the car is not in the register, a fine is generated automatically.

    Thus, in Moscow there is no need for disabled persons to stand in line for permission on a special form.

    All of the above rules are mandatory not only for motorists, but also for legal entities that work in the parking field.
    If any violations are detected, the relevant articles of the Code of Administrative Offenses of the Russian Federation come into force.

    Table 2. Penalties possible for violation of parking rules.

    A parking permit for disabled persons is issued for a vehicle that:

    • is the property of a person with disabilities;
    • issued by social security for use free of charge for medical reasons;

In parking lots located near shopping centers, sports, cultural and entertainment, medical and social institutions, at least 10% of the spaces are allocated for people with disabilities (but not less than one space). Parking spaces for people with disabilities are also provided in the local area.
