American justice rarely manages to reach out to Russian hackers and carders, who constantly carry out hacking in the United States and siphon billions of dollars from the US banking system. But when this is successful and if guilt is proven, the guys receive maximum sentences.

On Friday, April 21, 2017, the Federal District Court in Seattle sentenced 27 years in prison Roman Valeryevich Seleznev, a 32-year-old citizen of the Russian Federation, son of Valery Seleznev, a current deputy of the State Duma of the Russian Federation from the LDPR party.

Roman is known on underground forums under the nicknames Bulba, Track2, 2pac, nCuX, etc. He himself traded dumps through the sites POS Dumps, track2.tv, bulba.cc, 2ras.ss - the latter sold millions of dumps taken from Target store terminals, Neiman Marcus, Michaels, Staples and Home Depot, in 2013-2014 it was the largest dump store on the Internet.

Roman Seleznev was put on the wanted list by Interpol with a “red notice”. He was detained at the airport in the resort city of Male in the Maldives by American intelligence agents on charges of computer fraud, hacking, hacking of bank accounts and theft of credit card dumps and causing damage to US citizens and organizations in the amount of about $2 million. After that, he was transported to the United States.

The Western District Federal Court in Seattle charged Roman with hacking retail point-of-sale systems throughout the United States in 2009-2011. According to the indictment, from his homes and apartments in Vladivostok, Indonesia and Bali, he operated international card forum sites to facilitate the theft and sale of stolen credit card data. 1.7 million dumps were found on Seleznev’s laptop, and more than $18 million in bank accounts obtained as a result of illegal transactions. These funds, in particular, were used to purchase two apartments in Bali with a total cost of $800 thousand.

On the computer they also found photographs of Roman driving various sports cars, as well as next to stacks of banknotes similar to 5,000 ruble bills.

According to proven episodes, Seleznev’s schemes made it possible to resell more than two million credit cards, which led to losses for the US banking system of more than $170 million. If we take into account the overall work of Roman’s carder forums, the total damage could amount to billions of dollars. Among the victims are 3,700 financial institutions and 500 companies around the world, mainly in the United States. For this reason, federal prosecutors call Seleznev “the biggest fish” from the carding world that has ever fallen into the hands of American justice.

In a handwritten letter to the court, Roman spoke about the problems of his difficult childhood in Vladivostok, about his alcoholic mother and how at the age of 17 he barely had enough money to pay for food and utilities. These difficulties forced him to make “the biggest mistake of his life,” as Roman writes, that is, they forced him to take up carding. He stole credit cards and other data that could be resold. Over time, he improved his hacking abilities and increased his volume. Then things got even more serious. He became rich, married Svetlana and moved to Bali. In general, a typical story of a Russian carder. The tragedy happened after the terrorist attack in Marrakech in 2011, where Roman’s part of his head was blown off, he fell into a coma for a long time, his wife left him and went to the USA with all the money and daughter. After emerging from a coma, Roman returned to carding, met a Ukrainian woman, Anna, whom he fell in love with, and she is still fighting for him with American justice.

The US Secret Service had been tracking Roman Seleznev for more than a decade, according to court documents. The search resulted in a successful arrest in June 2014 in the Maldives.

It is curious that the Maldives does not have an extradition treaty with the United States, so Roman felt safe there - and purchased real estate. However, Interpol and the US Department of Justice through the State Department managed to reach an agreement with law enforcement agencies in the Maldives to help detain the Russian. For this purpose, a special plan was developed, according to which the hacker was detained at the airport right before boarding a plane flying to Russia.

Agents placed Roman under surveillance immediately after he arrived in Male. During his journey from the terminal to the airport, he was already under close surveillance: several agents were sitting with him on the bus, a couple of rows behind him. As soon as Roman handed over his passport to control at the airport, he was immediately handcuffed.

Local authorities simultaneously announced the expulsion of Roman from the country. Instead of a plane home, American intelligence services put the Russian on a private plane, which took him to a prison on the American island of Guam, and from there he was transported to the United States.

Deputy Seleznev subsequently offered $50 thousand for the video recording of his son’s detention and expressed the opinion that economic sanctions should be introduced against the Maldives.

In August 2016, the jury found Seleznev’s guilt proven in 38 episodes of the criminal case. Of these, ten relate to cyber fraud and nine relate to unauthorized access to computer networks. The prosecutor asked for 30 years in prison for Roman, and on April 21, 2017, the judge issued such a verdict, taking into account the fact that Roman had already served three years.

Informative commentary by SBKarr

For those wondering where 27 years old is from

The gentleman is accused of 40 counts of criminal activity (felony), of which 38 are related to hacking. In US law, episodes are grouped, after which each group is either summed up or absorbed by the largest. The largest group is presented as punishment. In addition, there are crimes that are not grouped and are summed up unconditionally by the deadline.

In the court decision, the episodes are grouped as follows (I will try to translate them so as to roughly correspond to our legal terminology:

  • 1-10 - Fraud using electronic digital means (Wire Fraud) - 336 months
  • 12-19 - Intentional damage to electronic computing devices performing important operational functions (Intentional Damage to a Protected Computer) together with
  • 21-29 - Illegally obtaining access to secret/protected information (Obtaining Information from a Protected Computer) - 60 months
  • 30-38 - Illegal access to devices (Access Device Fraud) - 120 months
As a result, we take the maximum period - 336 months. 24 months are added to them for points 39 and 40 (knowingly giving false testimony). We get 360 months, or 30 years.
Counts 11 and 20 appeared to relate to organizing criminal activity and the jury found they were not proven.

Now about some interesting things.

In addition to this system, the United States has developed a special scoring table that makes it possible to formalize aggravating parameters and increase the sentence in proportion to the severity. For Seleznev, the table takes into account, for example, the following points:

  • Loss in excess of $550 million - total financial losses exceed 550 million
    10 or more victims - more than 10 victims
  • Scheme committed from outside of the U.S. - the crime was committed from outside the United States
  • Organizer/leader - the defendant is the leader of a criminal organization
  • Obstruction of justice - the defendant obstructed the administration of justice
According to this table, the prosecution should have recommended a life sentence, but the use of such “modifiers” is only permissible in certain cases, for example, if the case falls under the RICO Act. But proving RICO is quite expensive, and not at all a fact. that Seleznev’s organization suits him. Therefore, "modifiers" were not used.

All the more surprising is the fact that these calculations are included in the conclusion, since, according to American laws, they are not relevant to the case and should have been withdrawn and excluded from the testimony for the jury. In my personal opinion, this is evidence of the low quality of legal assistance provided to a citizen of the Russian Federation, since such calculations clearly set the jury against the defendant.

One can notice something odd in the verdict; in the description of the groups of episodes, the following is written:

as to each of counts 1-10 (Wire Fraud), defendant shall serve 336 months to be run concurrently with one another, and also concurrently with all other counts except counts 39 and 40

That is, the sentence for episodes must be served together with other episodes, and together with other groups of episodes. If you think about it, this means that for 1 episode of Wire Froud they give 28 (!) years. This incident is a historical feature of the United States. Fraud involving federal communications (postal services, telecom operators) and financial (banks) institutions is a particularly serious crime in the United States.

The proposed scheme of charges is interesting, according to which the charges against Seleznev were prepared in several states at once, and the episodes were distributed among all. At least two states were preparing to bring charges under the mentioned RICO Act, requiring life imprisonment. The interesting thing is this: in any legal country no one can be tried for the same crime twice, but in the USA a person can be tried for the same crime several times in different states if the charges do not completely coincide in the episodes. That is, it is worth replacing one episode with one for which no charges were brought - and a new trial in another state is ready. There are a lot of episodes in the Seleznev case.

Family

He was married several times. Has four sons from different marriages.

Criminal prosecution of Roman's son in the USA

The son from his first marriage, Roman, born in 1984, graduated from the Far Eastern Federal University with a degree in Trade Economics. The father claims that after the terrorist attack in Marrakesh, Roman became disabled. On July 5, 2014, Roman Seleznev was detained at the airport in Male in the Maldives by American intelligence agents on charges of computer fraud, hacking, hacking of bank accounts and theft of personal data of credit card holders and causing damage to US citizens and organizations in the amount of about $2 million . After this, Roman was transported to a prison on the American island of Guam, and then to the United States.

The father, Valery Seleznev, regarded the detention of his son in the Maldives as a kidnapping and turned to the Russian Foreign Ministry for support. Law enforcement agencies of the Maldives, however, rejected the accusations of the Russian Foreign Ministry in the kidnapping of Roman: the arrest was carried out within the framework of the law - in accordance with the Interpol “red notice” and with its assistance.

The Federal District Court for the Western District in Seattle (Washington) charged Roman with hacking into the system of retail sales points throughout the United States in 2009-2011. According to the indictment, he used malware to control the servers and websites of international card forums to facilitate the theft and sale of stolen credit card data. According to the investigation, 1.7 million credit card numbers were found on the hard drive of Seleznev Jr.’s laptop, and more than $18 million received as a result of illegal transactions were found in his bank accounts. These funds, in particular, were used to purchase two apartments in Bali with a total cost of 800 thousand dollars.

Notes

An excerpt characterizing Seleznev, Valery Sergeevich

“I don’t know...” Stella whispered quietly. “For some reason people were very angry back then, even angrier than animals... I looked a lot to understand, but I didn’t understand...” the little girl shook her head. “They didn’t listen to reason, they just killed.” And for some reason everything beautiful was destroyed too...
– What about Axel’s children or wife? – Having come to my senses after the shock, I asked.
“He never had a wife - he always loved only his queen,” said little Stella with tears in her eyes.

And then, suddenly, a flash seemed to flash in my head - I realized who Stella and I had just seen and for whom we were so sincerely worried!... It was the French queen, Marie Antoinette, about whose tragic life we had very recently (and very briefly!) took place in a history lesson, and the execution of which our history teacher strongly approved, considering such a terrible end to be very “correct and instructive”... apparently because he mainly taught “Communism” in history. .
Despite the sadness of what happened, my soul rejoiced! I simply could not believe the unexpected happiness that had fallen upon me!.. After all, I had been waiting for this for so long!.. This was the first time when I finally saw something real that could be easily verified, and from such a surprise I almost squealed from the puppyish delight that gripped me!.. Of course, I was so happy not because I didn’t believe in what was constantly happening to me. On the contrary, I always knew that everything that happened to me was real. But apparently I, like any ordinary person, and especially a child, sometimes still needed some kind of, at least the simplest confirmation that I was not yet going crazy, and that now I could prove to myself, that everything that happens to me is not just my sick fantasy or invention, but a real fact, described or seen by other people. That’s why such a discovery was a real holiday for me!..
I already knew in advance that as soon as I returned home, I would immediately rush to the city library to collect everything I could find about the unfortunate Marie Antoinette and would not rest until I found at least something, at least some fact that coincided with our visions... Unfortunately, I found only two tiny books, which did not describe so many facts, but this was quite enough, because they completely confirmed the accuracy of what I saw from Stella.
Here's what I managed to find then:
the queen's favorite person was a Swedish count named Axel Fersen, who selflessly loved her all his life and never married after her death;
their farewell before the count's departure to Italy took place in the garden of the Little Trianon - Marie Antoinette's favorite place - the description of which exactly coincided with what we saw;
a ball in honor of the arrival of the Swedish King Gustav, held on June 21, at which all the guests for some reason were dressed in white;
an escape attempt in a green carriage, organized by Axel (all other six escape attempts were also organized by Axel, but none of them, for one reason or another, failed. True, two of them failed at the request of Marie Antoinette herself, since the queen did not wanted to run away alone, leaving her children);
the beheading of the queen took place in complete silence, instead of the expected “happy riot” of the crowd;
a few seconds before the executioner struck, the sun suddenly came out...
The queen's last letter to Count Fersen was reproduced almost exactly in the book "Memoirs of Count Fersen", and it almost exactly repeated what we heard, with the exception of only a few words.
Already these small details were enough for me to rush into battle with tenfold force!.. But that was only later... And then, in order not to seem funny or heartless, I tried my best to pull myself together and hide my delight at my wonderful insight." And in order to dispel Stellino’s sad mood, she asked:
– Do you really like the queen?
- Oh yes! She is kind and so beautiful... And our poor “boy”, he suffered so much here too...
I felt very sorry for this sensitive, sweet little girl, who, even in her death, was so worried about these completely strangers and almost strangers to her, just as many people do not worry about their closest relatives...
– Probably in suffering there is some amount of wisdom, without which we would not understand how precious our life is? – I said uncertainly.
- Here! Grandma says that too! – the girl was delighted. – But if people only want good, then why should they suffer?
– Maybe because without pain and trials, even the best people would not truly understand the same goodness? – I joked.
But for some reason Stella did not take this at all as a joke, but said very seriously:
– Yes, I think you’re right... Do you want to see what happened to Harold’s son next? – she said more cheerfully.
- Oh no, perhaps not anymore! – I begged.
Stella laughed joyfully.
- Don't be afraid, this time there will be no trouble, because he is still alive!
- How - alive? – I was surprised.
Immediately, a new vision appeared again and, continuing to surprise me unspeakably, this turned out to be our century (!), and even our time... A gray-haired, very pleasant man was sitting at the desk and was thinking intently about something. The whole room was literally filled with books; they were everywhere - on the table, on the floor, on the shelves, and even on the windowsill. A huge fluffy cat was sitting on a small sofa and, not paying any attention to its owner, was intently washing itself with its large, very soft paw. The whole atmosphere created the impression of “learnedness” and comfort.
“What, is he living again?..” I didn’t understand.
Stella nodded.
- And this is right now? – I didn’t let up.
The girl again confirmed with a nod of her cute red head.
– It must be very strange for Harold to see his son so different?.. How did you find him again?
- Oh, exactly the same! I just “felt” his “key” the way my grandmother taught me. – Stella said thoughtfully. – After Axel died, I looked for his essence on all the “floors” and could not find it. Then I looked among the living - and he was there again.
– And do you know who he is now, in this life?
– Not yet... But I’ll definitely find out. I tried many times to “reach out” to him, but for some reason he doesn’t hear me... He is always alone and almost all the time with his books. With him are only the old woman, his servant and this cat.
- Well, what about Harold’s wife? “Did you find her too?” I asked.
- Oh, of course! You know your wife - this is my grandmother!.. - Stella smiled slyly.
I froze in real shock. For some reason, such an incredible fact did not want to fit into my dumbfounded head...
“Grandma?..” was all I could say.
Stella nodded, very pleased with the effect produced.
- How so? Is that why she helped you find them? She knew?!.. – thousands of questions were simultaneously spinning madly in my excited brain, and it seemed to me that I would never have time to ask everything that interested me. I wanted to know EVERYTHING! And at the same time, I understood perfectly well that no one was going to tell me “everything”...
“I probably chose him because I felt something.” – Stella said thoughtfully. - Or maybe grandma brought it up? But she will never admit it,” the girl waved her hand.
- AND HE?.. Does he know too? – that’s all I could ask.
- Well, of course! – Stella laughed. - Why does this surprise you so much?
“She’s just old... It must be hard for him,” I said, not knowing how to more accurately explain my feelings and thoughts.
- Oh no! – Stella laughed again. - He was happy! Very, very happy. Grandma gave him a chance! No one could have helped him with this - but she could! And he saw her again... Oh, it was so great!
And only then did I finally understand what she was talking about... Apparently, Stella’s grandmother gave her former “knight” the chance that he had so hopelessly dreamed of throughout his long life remaining after physical death. After all, he had been looking for them so long and persistently, so madly wanted to find them, so that just once he could say: how terribly he regrets that he once left... that he could not protect... that he could not show how much and he loved them selflessly... He needed to death that they would try to understand him and be able to somehow forgive him, otherwise he had no reason to live in any of the worlds...
