Laws governing the rights and benefits of persons with disabilities

Who is given disability group 3?
The third group, as a rule, is assigned to those who have minor health anomalies (deviations from the norm), which are stable and caused by a certain disease (congenital or acquired). As conditions that allow a person to be assigned the group in question, experts identify:
Ability to move independently, perform daily self-care, and meet key needs without assistance from anyone (such as a caregiver);
Ability to perform work (sometimes in a different position) with minor restrictions (say, the worker needs special equipment or reduced hours in the work schedule);
The need for social protection, sanitary, preventive and rehabilitation measures.

Disability as a fact and a group of limitations is determined by medical experts carrying out the examination.
Features of passing the ITU
The following deviations are basic for assigning group 3:
Hearing, vision and/or speech function abnormally;
Diagnosed with a mental disorder;
There are problems (acquired or present from birth) with the limbs and/or musculoskeletal system;
Some types of disorders associated with blood circulation have been demonstrated;
There are serious defects that have developed in the musculoskeletal tissue, respiratory system or ophthalmological profile.
The examination was created in order to confirm the accuracy of the diagnosis, define and record disability as a fact, and also indicate its timing with adaptation methods (if necessary). This provision is spelled out in Federal Law No. 181 of November 24, 1995. To go through the process, you must take a referral from your physician. In addition to this paper, to get to ITU, you cannot do without:
Identity cards;
A copy of the work book certified by the management of the organization or a notary (if available);
Income statements (if available);
Outpatient card;
Characteristics (taken from the place of study or work);
A statement indicating that the person wishes to undergo an examination;
Pension certificate (when it is in hand);
Report on work injury, if any.
The ITU ends with the preparation of an act, which is then submitted to the federal expert bureau and the Pension Fund of the Russian Federation. On the basis of this certificate, the disabled person is allocated the social benefits provided for in his case. Please note that it is necessary to undergo examination for group 3 every year within the specified period (it is recorded in the disability certificate). Pension for disabled people of group 3 in 2019
Pension legislation in group 3 guarantees a social or insurance (labor) pension, plus MDV (monthly cash payment). A social pension is provided to minors and adult citizens of the Russian Federation permanently residing in the country (see Federal Law No. 166 of December 15, 2001). Those who have work experience are given a labor pension.
Social pension
The amount of social pension for disability group 3 in 2019 reaches 4491.30 ruble month, including minors.
When do they raise?
The amount changes upward (indexed) on April 1 every year and the percentage of increase represents the difference in the cost of living for this and last year (for all groups). In 2019, indexation is 2%. That is approximately 100 rubles.
Labor (insurance) pension
In this case, calculations are made using a special formula that takes into account the length of service. The minimum (basic) monthly pension is equal to:
- RUB 2667.10. for single persons with disabilities;
- 4445.16 RUR., if there is a dependent;
- 6223.22 RUR. if there are several dependents;
- RUB 8,001.28. with three dependents.
When do they raise?
Taking into account the changes made to the legislation, insurance pensions (for disability too) are indexed in January, and not in February, as was before. The increase represents the amount of inflation recorded over the past year. But the pension reform made it possible to increase insurance pensions by 1000 rubles (7%), and monthly.
EDV and NSU for group 3 - what is included, amount of payments
In addition to physical benefits, social benefits have a monetary equivalent, that is, a monthly allowance or a supplement to the pension. In general, the range of social services includes those provided free of charge:
Prescription medications (or a 50% discount is possible);
Travel by suburban and railway transport to the place of treatment and back (this also applies to the person accompanying the disabled person);
Sanatorium-resort treatment.
To use the listed preferences or replace them with a fixed cash increase to your pension, it is enough to submit a corresponding application to the Pension Fund.
From February 1, 2019, the amount of EDV reached 2162.51 rubles. The social package in the EDV accounts for 1121.41 rubles, including:
- 863.76 rubles for medications;
- 133.61 rubles for a trip;
- 124.05 rubles for travel.
Important: When choosing a natural form of benefits, the payment of EDV will decrease by 1000 rubles, since the social package is part of the EDV.
Care allowance
At the moment, the legislation does not provide for such an opportunity as registering a non-working able-bodied person to care for a holder of group 3 disability.

Discounts on housing and communal services
Disabled people living in public, municipal, state housing stock, can count on a several-fold reduction (by 50%) in utility costs for:

Water supply and sanitation;

Preferential taxes
Taxes for the category of citizens in question may be reduced. In particular, we are talking about:

Removal of tax liability if a disabled person of group 3 owns a specialized car (up to 100 hp).
Benefits for medicine
As part of providing people with group 3 conditions for rehabilitation, the state provides:
Unemployed disabled people get a 50% discount on medicines;
Preferential or free treatment;
Free prosthetics and other technical equipment. means necessary for life;

Annual travel to a sanatorium or dispensary.

Also, during training, a person with disabilities receives a scholarship, regardless of the results achieved at the examination sessions.
Benefits for working disabled people
An employer who hires an employee with group 3 has specific responsibilities, for example, he must provide working conditions that will not be worse than those of other employees. Plus, a disabled person has the right to paid leave of up to 30 days (no less), and unpaid days can be increased several times, that is, up to 60 days a year.
If it is necessary to involve an employee with a disability group in additional work, or performing his tasks at night, on weekends and holidays, you will need to take his consent to this, stated in writing. - when paying for utilities - the right to receive part or the full amount of these funds back through the social security authorities;
