According to the law, parking spaces for disabled people, including those located next to shops, medical, sports and other institutions, must occupy at least 10% of parking spaces of the total number. Moreover, they can use them for free.

The law on parking in Moscow for persons with disabilities states that persons with disabilities have the right to use free parking, indicated by a special sign. Who handles parking permits?

According to the decree of the Moscow city government, starting in 2013, a special register was created, which contains all permits for parking spaces for persons with disabilities. Its formation is carried out by the State Public Institution "AMPP".

The register contains the following data:

  • Last name, first name and patronymic of the person with a disability;
  • His contact details or his representative;
  • Residence address;
  • Vehicle details (make and registration number);
  • Term and date from the date of disability;
  • Information about the preferential category;

What kind of car can I get a permit for?

According to the rules of parking for disabled people on a paid basis, the requirements for the car are also stipulated, for which the permit is issued. To do this, it must meet a certain number of conditions:

  • The car is owned by an owner who has a disability.
  • The car is owned by a person who is the legal representative of a child with a disability.

Procedure for obtaining a parking permit for disabled people

Before applying for a permit, a driver with a disability group, or his representative, must contact the multifunctional center to draw up and submit the appropriate application. The norms of the Federal Law dated November 24, 1995 N 181-FZ indicate that disabled parking must occupy at least 10% of the total number of parking spaces for vehicles.

Administrative penalties for violations related to parking for disabled people

For violating the rules on allocating spaces for disabled people in parking lots and stops, officials face a fine of up to 5 thousand rubles.

Legal entities that do not place on their territory a sufficient number of places for disabled people's cars will be required to pay a fine in the amount of 30,000 to 50,000 rubles. In Part 2 of Art. 12.19 of the Code of Administrative Offenses of the Russian Federation provides for punishment for persons who violate the rules of stopping and parking in places designated for disabled parking. Such violators will have to pay a fine of 5,000 rubles.

Decree of the Moscow Government dated May 17, 2013 N 289-PP established the rules governing the procedure for monitoring parking spaces for disabled people (Appendix No. 4).

What kind of car can I get a permit for?

Car owners with disabilities have the right to obtain a permit for free parking for a car that:

  • is owned by a disabled person;
  • is the property of the legal representative of a disabled child;
  • was issued to a disabled person by social security authorities due to medical indications;
  • belongs to persons transporting a disabled person. The only exceptions to the rule are cars used for paid transportation of passengers;
  • equipped with a special “Disabled” sign.

How to apply for a permit?

Persons with disabilities or their representatives can apply for a parking permit at the multifunctional center.

In addition to the application, a person applying for a free parking permit for a disabled person should have the following documents with him:

  • applicant's passport;
  • passport of the applicant's representative;
  • certificate of disability;
  • a document confirming the authority of the representative of a disabled child.

MFC employees review the application and the documents attached to it within 10 days.

The application can also be submitted electronically. To do this, the applicant will need to submit documents through the Moscow government services website.

Free parking for large families

Government authorities provide for the issuance of free parking permits to large families. But 1 family has the right to obtain only 1 permit. It will operate within the paid city parking zone. The permit is valid for 1 year.

You can only obtain a permit for a car without arrears on administrative fines. It is also necessary that the vehicle for which the permit is issued be the property of one of the parents or adoptive parents in a large family.

According to the Federal Law “On Social Protection of Persons with Disabilities in the Russian Federation,” people with disabilities have the right to use parking free of charge. In parking lots near shopping centers, sports, cultural and entertainment, medical and social institutions, at least 10% of the total area is allocated for people with disabilities. Where can a disabled person park?

Parking spaces for people with disabilities are marked with special markings and an identification sign “Disabled”. The width of the parking space for disabled people is greater than the space for regular vehicles - 3.5 meters. Can a disabled person use paid parking for free?

A parking permit is issued for a car owned by a person with a disability, or his legal representative, or a guardian of a disabled child. The benefit also applies to a vehicle provided by social security authorities for medical reasons. In this case, a permit is issued only for one car used by the beneficiary.

A car for which a disabled parking permit has been received must be equipped with a “Disabled Person” sign measuring 15 by 15 cm. Only after this will people with disabilities be able to use free parking.

Until recently, the use of parking for disabled people was not clearly enshrined in legislation; the text of the resolution did not mention the need to have a certificate of disability; there was no information that the right to install a “Disabled Person” sign does not apply to cars transporting healthy citizens. New rules

In 2019, who has the right to park in a disabled parking lot? Today, the driver of a vehicle with the identification sign “Disabled” is required to carry and present to the traffic police officer a certificate of disability. If a vehicle is driven by several drivers, and not all of them are disabled, a quick-removable identification plate must be installed on the vehicle. In accordance with the traffic rules, benefits for paid parking for disabled people apply only to disabled people of groups 1 and 2, as well as to any group during transportation. Thus, a driver without health limitations also has the right to purchase and install a “Disabled Person” sign, but he no longer has the right to stop in parking lots for the disabled. If a certificate of disability is presented, which is not necessarily issued in the name of the driver, no fine will be issued.

What is the GOST for the disabled parking sign? Parking spaces are marked with special markings and an identification sign “Disabled”, which schematically depicts a person in a wheelchair.
Within megacities, double markings are provided; in this case, markings for 3 ordinary cars are applied to two vehicles allocated for disabled people.
Currently there are the following requirements for parking spaces:

  • 10% of the total area - parking lots located close to public places;
  • 20% of the total area - parking lots near hospitals, hospitals, clinics and other special institutions that can be visited by patients with musculoskeletal disorders.

Responsibility for violating the rules

How much is the fine for parking in a disabled space in 2019? Just a few years ago, the fine was only 200 rubles, and as a result, drivers abandoned their cars anywhere. Despite the increase in the amount of penalties, car owners continue to violate the rules; in this regard, the issue of tightening penalties is being considered, including the deprivation of a driver's license and the initiation of legal proceedings.
