The problem of free parking for disabled people is relevant not only in megacities, but also in small towns in Russia. On the one hand, benefits are guaranteed by the state, on the other, the flow of vehicles is constantly growing, and parking spaces are constantly in short supply.

According to (dated November 24, 1995), the owner of a paid parking lot is obliged to provide a certain area for places for persons with limited physical capabilities. This area must be no less than 10% of the total parking space. In case of violation of these norms, administrative liability is provided.

Regulatory framework and conditions for receiving benefits

Many people are interested in which disabled people are entitled to free parking and what needs to be done to receive this benefit. The conditions for granting the right to free parking for disabled people in Moscow and any other city are no different. Disabled people of all 3 groups, without exception, have the right to a free parking space. The factor of geographical location and registration does not matter.

The immediate basis for the implementation of the benefit is a certificate of disability, as well as a parking permit.

A person entitled to free parking due to a disability must fulfill the following conditions:

  • draw up a document indicating a parking permit;
  • install a special identification sign on the car;
  • take one of the allocated parking spaces.

Important! According to regulatory regulations, one parking permit is required per citizen.

Where and how to apply for a benefit

You can obtain permission for free parking at any multifunctional center (MFC) by following a number of steps:

  1. Collect the necessary documents (a detailed list is given in the next paragraph).
  2. Visit the MFC.
  3. Fill out the application form in the prescribed form.
  4. Wait for the result of the application review.

Having received a notification that you have been assigned free parking benefits, you must register the car for which the parking permit is issued in a special database where basic information on the subject of the preferential preference is recorded.

In particular, the following information is entered into this register:

  • number of the preferential parking certificate and its validity period;
  • last name, first name, patronymic of the disabled person or his legal representative;
  • registration address, contact details;
  • make and license plate number of the car;
  • insurance information;
  • disability category of the beneficiary.

Advice! All data is thoroughly checked, so the information must be provided in full and accurately.

Required documents

Depending on whether the disabled person directly applies for the benefit or the person representing him, the package of documents required for registration of preferential parking is somewhat different.

If the benefit is applied for by a disabled citizen himself, he must provide the following to the MFC:

  • passport;
  • certificate of disability;
  • certificate of compulsory pension insurance (SNILS).

When applying for free parking for children with disabilities, a birth certificate is required instead of the applicant's passport. The legal representative must present a passport or other document confirming his authority (a priori, parents are considered the legal representative, but other cases are possible).

If a car was provided to a disabled person as part of a social protection program, it is necessary to provide the MFC with a certificate issued by the relevant authority.

Deadlines for reviewing documents

According to the standards established by law, the period for consideration of applications and documents submitted for registration of parking benefits at the MFC is 10 days. The applicant will be notified of the final decision in writing, as well as in other ways specified when filling out the application.

Modern technologies allow people with disabilities to contact the MFC via the Internet. To do this, you need to go to the center’s website and register in the database. After this, you should follow a simple algorithm of the prescribed actions, enter the necessary information and wait for a response by email.

How long does the parking discount last?

  • for 1 year - in accordance with the rules for registering disability of groups 2 and 3,
  • indefinitely - for disabled people of group 1.

After one year, disabled people of groups 2 and 3 are required to undergo a medical and social examination procedure that establishes the presence of physical limitations, i.e. must confirm disability. Until the status is confirmed, the benefits are suspended (interrupted).

Advice! It is important to remember that the right to receive parking preferences is for one vehicle per person with a disability. If you change your vehicle (most often a car), you will have to re-register your documents.

Features of the practical use of the benefit

When transporting a disabled person, using the right to free parking must take into account some basic rules:

  1. Preferential parking spaces are marked with special signs. If a disabled person or the person responsible for their transportation occupies a space that does not have special markings, parking is paid on a general basis.
  2. Parking benefits for families raising a disabled child are provided for only one vehicle.
  3. The legal representative of a disabled person may be parents, relatives or other persons whose powers are legally secured.

Advice! It is better to issue a parking permit for a specialized car, and if this is not possible, then for a car that is maximally adapted for transporting a person with disabilities.

Given the fairly high cost of parking in Moscow, for example, getting free parking for a disabled person is really very important. This not only saves money, but also makes it more convenient to get to your destination, which ultimately improves the standard of living of people with disabilities and improves the logistics of the city. Often, special passengers or drivers require more time or special conditions (for example, a large space in front of the doors to enter the car) to start moving. If such a car is forced to occupy a regular, rather than preferential, parking space, this often makes movement difficult. That’s why it’s so important to follow parking lot markings.

Penalties associated with violations

The rights of people with disabilities are protected by federal legislation, and any violation of them entails administrative liability.

Let's look at the main sanctions associated with violations of regulations regarding preferential parking for people with disabilities.

Since 2012, parking for disabled people in Moscow has become paid. But there is a certain category of citizens who have the right to park for free. This also applies to people with disabilities. So what are the parking rules for disabled people in Moscow for disabled people - we will now find out in more detail.

After paid parking lots were introduced in Moscow, according to the Federal Law concerning the social protection of disabled people in the Russian Federation, their owners are obliged allocate a certain number of free parking spaces, which are intended for drivers with a disability group and are indicated with a special sign. They can also be used by persons transporting people with disabilities.

According to the law, parking spaces for disabled people, including those located next to shops, medical, sports and other institutions, must occupy at least 10% of parking spaces of the total number. Moreover, they can use them for free.

How is the parking sign for the disabled indicated, and what do you need to have with you to take such a place? The disabled parking sign is indicated by marking 1.24.3.

The law on parking in Moscow for persons with disabilities states that persons with disabilities have the right to use free parking, indicated by a special sign. These include disabled people of groups I and II. And the basis for this may be an officially issued permit. Parking spaces are available 24 hours a day. But according to the same parking rules for disabled people in the city of Moscow, if occupying spaces not intended for citizens of this category, that is, without a sign with special markings, he must pay for it on a general basis.

When parking in places marked with a parking sign for disabled people, the driver must have documents confirming this fact. These include a certificate or a regular certificate. Disabled person sign stuck on a car window is not proof of disability. On the other hand, the presence or absence of this sign is entirely at the discretion of the car owner. By law, it is not necessary to stick this sign on the glass of a vehicle.

Who else can use free parking spaces?

There is also another category of persons who have the right to take advantage of this benefit. These include drivers who transport persons belonging to such a group. Drivers who are not disabled, but are engaged in transporting such people or accompany disabled children, have the right to install the appropriate sign on their car and occupy this place. But this is only possible during the transportation of a disabled person who has supporting documents with him. In all other cases, according to the parking rules in Moscow for disabled people, the presence of a sign on a car is illegal.

Who handles parking permits?

According to the decree of the Moscow city government, starting in 2013, a special register was created, which contains all permits for parking spaces for persons with disabilities. Its formation is carried out by the State Public Institution "AMPP".

The register contains the following data:

  • Last name, first name and patronymic of the person with a disability;
  • His contact details or his representative;
  • Residence address;
  • Vehicle details (make and registration number);
  • Term and date from the date of disability;
  • Information about the preferential category;
  • validity period with registration number of the parking permit.

What kind of car can I get a permit for?

According to the rules of parking for disabled people on a paid basis, the requirements for the car are also stipulated, for which the permit is issued. To do this, it must meet a certain number of conditions:

  • The car is owned by an owner who has a disability.
  • The car is owned by a person who is the legal representative of a child with a disability.
  • A car provided to a disabled person by social services. protection, according to medical indications.
  • The car is owned by the person who transports the disabled passenger, unless a fee is charged for the carriage.

Procedure for obtaining a parking permit for disabled people

Before applying for a permit, a driver with a disability group, or his representative, must contact the multifunctional center to draw up and submit the appropriate application. IN within a ten-day period, an application with a copy of the attached documents will be reviewed and a decision will be made based on them. You can also submit an application online on the website.

  • To do this, you must go to the Moscow city government services website, go through the registration process or log in.
  • Then go to the “transport” tab and select the “issue a parking permit” item.
  • Then we upload scanned copies of the specified documents and send the request. The result will also be known after ten days.

Required package of documents:

  • The following list of documents must be attached to the application for a parking permit.
  • Passport of a person with a disability.
  • Passport of the legal representative.
  • If the application is submitted on behalf of a representative of a disabled child who is not his parent, then you will need to provide a document confirming these powers.
  • A certificate confirming disability or an extract from the examination report.

Pay attention! If there is no information about the disabled person in the Department of Social Services. defense of the city of Moscow, the consideration of the case will be suspended.

What are the penalties for parking lot owners?

Despite the fact that parking lot owners lose part of their profits, they are required to allocate as many parking spaces marked with a “disabled person” sign as provided by parking rules for such people in the first and second groups. In case of violation of these rules, Article 5.43 comes into force, which provides for a fine for the absence of parking spaces with such a sign. For an individual, this can cost anywhere from three to thousands of rubles.

Organizations can pay a fine of 30 to 50 thousand. Of course, when faced with such a choice, owners prefer to equip the required number of seats with a special sign rather than pay such amounts.

Fine for illegal use of parking lot

Despite the fact that the rules regarding parking for disabled people of the first group in Moscow quite clearly describe the category of persons who have the right to use free spaces with this sign. It often happens that they are occupied by cars whose owners are not included in this circle of people.

Even if we do not take into account the ethical side of this issue, you will agree that it is not entirely correct to take the places of those for whom overcoming the extra footage causes great difficulty. This kind of violation can bring many unpleasant moments to the violators.. According to the same Code of Administrative Offenses of the Russian Federation (Article 12.19), in case of unlawful actions the violator faces a fine of five thousand rubles.

By the way, this is the largest fine for illegal parking. Persons occupying other people's places are still at risk because traffic police officers closely monitor such places. After all, to issue a fine you need very little: wait until a driver who does not belong to this category stops at a place with markings for disabled people and take a photograph of the fact of the violation, and after that you can issue a receipt.

Special parking spaces for disabled people in vehicle parking areas in the Russian Federation should be equipped everywhere. Moreover, such a requirement is enshrined in legislation, special parking rules for disabled people, benefits for this category of citizens, etc. are established.

What are the rules for paid parking for disabled people? What benefits do people with disabilities enjoy in paid parking lots? Are there special spaces in paid parking lots for people with disabilities and how many should there be by law? How can a disabled person apply for and receive a parking permit? We will answer these questions in this article.

Paid parking rules for disabled people

Parking lots with parking spaces intended for transport of persons with disabilities have a special designation: a “disabled persons” sign under the “parking area” sign and road markings on the parking space itself.

According to Federal Law No. 181-FZ dated November 24, 1995, a limit is established on the number of parking spaces for disabled people. The maximum number of parking spaces for disabled people in the parking lot can reach 10% of the total number of parking spaces.

For non-compliance with paid parking rules in terms of violation of the rules regarding parking spaces for disabled people, penalties are provided within the framework of administrative legislation. Their size is differentiated and depends on the category of the offender. Thus, penalties in the amount of 30-50 thousand rubles can be applied to business entities; a fine in an amount not exceeding 5 thousand rubles is applied to an individual (if a specific official of the business entity is involved).

Citizens who do not belong to the category of disabled people who neglect parking rules and occupy a specially designated space can be punished under Article 12.19, Part 2 of the Code of Administrative Offenses of the Russian Federation and given a fine of up to 5 thousand rubles.

Benefits for disabled people when using paid parking

To make it easier to identify the transport of a group I or II disabled person, it is necessary to place an appropriate identification sign on such transport. These parking spaces are available 24 hours a day. In this case, parking of vehicles in a place not intended for parking of persons with disabilities is paid on a general basis.

Registration of a parking permit for disabled people

The rules that establish the procedure for monitoring parking spaces for persons with disabilities are established by Decree of the Moscow Government No. 289-PP dated May 17, 2013. As part of the implementation of the rules established by the government, Moscow government agencies are charged with maintaining a special register of parking permits for people with disabilities. In particular, the register is formed in the “Administrator of the Moscow Parking Space” or abbreviated as GKU “AMPP”. The register indicates:

  • registration number and period during which the permit is valid;
  • personal data of a person with a disability to whom a permit was issued (full name);
  • information about the place of residence of the owner of the vehicle;
  • contacts of either a person with a disability or his legal representative;
  • identification information about the vehicle (make, model, registration number);
  • SNILS;
  • name of the preferential category;
  • date of establishment of disability and duration of its establishment.

The right of a person with a disability to obtain a parking permit applies to:

  • transport owned;
  • own transport of the legal representative of a disabled child;
  • transport that was issued to a person with a disability by social protection authorities based on medical indications;
  • own transport of persons transporting disabled people. This rule does not apply to the transport of carriers that provide their services on a paid basis, for example, taxis;
  • transport that has a special “disabled person” sign.

Procedure for obtaining a permit

An application for issuance of the appropriate permit is submitted through the MFC by the person with a disability or his legal representative. You can download the application form from the link. The application is supplemented with certain documents, including:

  • the passport of the person submitting the application, and if the applicant is the legal representative, then the passport of the person with a disability whose interests are represented;
  • document establishing disability;
  • a document for the representative of a disabled child, which would confirm his powers as a representative.

Review of the submitted package of documents takes up to 10 days.

An alternative way to personally visit the MFC can be an electronic application for a permit. You can leave it by filling out an electronic form on the Moscow State Services portal. Documents that must be attached to the application must first be digitized (scanned) and attached to the application.

The absence of an appropriate permit for a person with a disability does not give the right to use free parking services, even though formally there are all grounds for this.

Conclusion

Thus, the right of citizens with disabilities to a free parking space is enshrined in law; accordingly, an administrative fine is provided for its violation. Parking spaces are marked with special markings, however, in order to use the parking space freely, you must obtain special permission by submitting a request through the MFC or State Services.

Car parking, especially in megacities, is now a problem. You have to pay for space for your car. However, citizens with health limitations often do not have free money. Therefore, they are legally allocated free parking for the disabled.

The regulatory framework related to paying for parking is changing rapidly.

Legislative framework

Who does the benefit apply to?

Preferential categories include drivers directly driving vehicles of all disability groups, as well as vehicles transporting disabled people, including disabled children. A vehicle applying for a free parking space must display a “Disabled Person” identification badge, issued for personal use by authorized executors at the federal level.

For the practical implementation of the benefit, it is necessary to obtain a parking permit for the car. The rule for providing it looks like this:

  • one disabled person = one car.

How the benefit is issued

Let's consider the algorithm for obtaining a parking certificate using a metropolitan example. For Moscow drivers, the parking problem is perhaps more pressing than for residents of other cities. To obtain the treasured document, you must contact any multifunctional center (MFC).

A disabled person's parking permit is provided to all citizens of the Russian Federation, regardless of registration.

What cars are issued a license for?

Features of using parking benefits

As in any other area, the issue under consideration has its own nuances. Let's clarify the most common mistakes that lead to problems.

  1. Parking spaces for beneficiaries are marked with a special sign. That is, if there are benefits, it is necessary to park the car only in the designated area.
  2. If a disabled driver (the person transporting him) occupies a space that is not equipped with a special sign, then you will have to pay for parking on a general basis.
  3. Families raising a child with disabilities can apply for a parking benefit for only one car. As a rule, this is a vehicle owned by the parent.
  4. The legal representatives of people with disabilities are their relatives, parents and other persons registered by law.

Latest changes

From 2020, people with disabilities will no longer need to confirm their right to free use of parking spaces in the MFC of their regions. From this period, a unified federal database of beneficiaries of this category will begin to operate throughout the Russian Federation.
